Welcome to ODFARM ("we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our website odfarm.in, our agriculture consultancy services, DPR preparation, bank loan and subsidy facilitation, farm setup, training, and any related services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.

Acceptance of Terms

By accessing our website, contacting us via phone, WhatsApp or email, or engaging us for any consultancy or project, you confirm that you have read, understood and agreed to these Terms along with our Privacy Policy. If you do not agree, please discontinue use of our Services.

Eligibility

• You must be at least 18 years of age
• You must have legal capacity to enter into a binding contract under Indian law
• You must provide accurate, current and complete information when engaging our Services
• You must comply with all applicable central, state and local laws of India

Our Services

ODFARM provides agriculture consultancy and project facilitation services, which may include:

• Detailed Project Report (DPR) preparation
• Bank loan and subsidy application support
• Farm setup, polyhouse and turnkey project guidance
• Training, workshops and on-field consultations
• Coordination with banks, NABARD, APICOL and government departments

We act as a consultant and facilitator. We are not a bank, lender, government body, or guarantor of loan / subsidy approvals. Final decisions on loans, subsidies and scheme eligibility rest solely with the respective banks and government authorities.

No Guarantee of Outcomes

While we apply our experience, diligence and best practices to every project, we do not guarantee:

• Approval of any loan, subsidy or government scheme application
• Specific yields, profits, returns or business outcomes from any farming project
• Timelines that depend on third parties such as banks, departments or vendors

Agriculture outcomes depend on weather, market conditions, execution and many other factors outside our control. All projections shared by us are indicative estimates, not guaranteed results.

Fees & Payments

• Initial consultations may be offered at a nominal fee, as communicated
• Project-specific fees (DPR, loan facilitation, farm setup, training) will be agreed in writing or via WhatsApp / email before work begins
• All fees are exclusive of GST and applicable taxes, unless stated otherwise
• Payments must be made through the official channels we share (bank transfer, UPI to registered account)
• We are not responsible for payments made to any unauthorised account or individual

Refund & Cancellation

Since our Services involve significant time, expertise and third-party coordination, fees once paid are generally non-refundable after work has commenced. In genuine cases of service non-delivery from our side, partial refunds may be considered at our sole discretion. Any refund request must be raised in writing to hello@odfarm.in within 7 days of the relevant transaction.

Client Responsibilities

• Provide accurate land, KYC, financial and project information
• Submit required documents on time to avoid project delays
• Cooperate with banks, departments and our team during verification or site visits
• Use the DPR, reports and advisory only for the project they were prepared for
• Comply with all licensing, environmental and statutory requirements applicable to the project

Intellectual Property

All content on the website — including text, graphics, logos, images, DPR templates, project models, training material, videos and downloadable resources — is the intellectual property of ODFARM or its licensors and is protected under Indian copyright and trademark laws.

You may not copy, reproduce, republish, resell or commercially exploit any part of our content, DPRs or proprietary material without our prior written consent.

Acceptable Use

You agree not to:

• Use our Services for any unlawful, fraudulent or misleading purpose
• Submit forged, false or tampered documents
• Attempt to disrupt, hack, scrape or reverse-engineer our website or systems
• Misuse our brand, name, logo or content for unauthorised promotions
• Harass, abuse or threaten our team, consultants or partners

We reserve the right to refuse, suspend or terminate Services for any user violating these Terms.

Third-Party Services & Links

Our Services involve coordination with banks, NABARD, government departments, vendors and technical partners. While we work only with reputed institutions, we are not responsible for their decisions, delays, fees, terms or actions. Any external links on our website are provided for convenience and are governed by their own terms.

Limitation of Liability

To the fullest extent permitted by Indian law:

• Our total liability for any claim shall not exceed the consultancy fees actually paid by you to us in the previous 6 months
• We are not liable for any indirect, incidental, special or consequential losses, including loss of profit, crop loss, market loss or business opportunity loss
• We are not liable for losses arising from inaccurate information provided by you, force majeure events, or third-party actions

Indemnity

You agree to indemnify and hold ODFARM, its directors, consultants and partners harmless from any claims, damages, liabilities, costs or expenses arising out of (a) your breach of these Terms, (b) your misuse of our Services, or (c) any false, inaccurate or unlawful information you provide to us.

Confidentiality

Both parties agree to keep all non-public business, financial and project-related information shared during our engagement confidential and to use it strictly for the purpose of delivering the agreed Services.

Termination

We may suspend or terminate your access to our Services at any time without notice if you violate these Terms, misuse our Services, provide false information, or for any conduct we determine to be harmful to ODFARM, our team or other clients. On termination, the relevant clauses on payment, confidentiality, intellectual property and limitation of liability shall continue to apply.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the courts at Bhubaneswar, Odisha, India.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, technology, legal requirements or business practices. The latest version will always be published on this page with a revised "Effective Date". Continued use of our Services after such updates will constitute acceptance of the revised Terms.
